General Terms and Conditions of Sale

Article 1 — Purpose

These general terms and conditions of sale govern all sales concluded on the luniescence.store website between Thierry Becourt, a sole trader operating under the name Luniescence, 35 Rue de l'Ancienne Mairie, 73190 Challes-les-Eaux (the "Seller"), and any non-business individual making a purchase (the "Customer").

Any order implies the unconditional acceptance of these terms and conditions in the version in force on the date of the order.

Article 2 — Products

The products offered are indoor and outdoor lighting fixtures. The photographs and descriptions are as accurate as possible but do not have absolute contractual value: slight variations in shade or dimensions may exist. Offers are valid subject to available stock.

Article 3 — Prices

Prices are indicated in euros, including all taxes, excluding delivery costs. The latter are displayed in the summary before validation. The Seller reserves the right to change its prices at any time; products are invoiced at the rate in force at the time the order is placed.

Article 4 — Order

The sale is deemed concluded upon validation of payment, evidenced by the sending of a confirmation email. The Seller reserves the right to cancel any order that appears abnormal or fraudulent, or that comes from a customer with whom a dispute is ongoing; the payment is then fully refunded.

Article 5 — Payment

Payment is made online, in full, by the means offered on the payment page. Banking data is processed by a PCI-DSS certified provider and is never accessible to the Seller.

Article 6 — Delivery

Delivery takes place at the address indicated by the Customer, usually within 14 business days in metropolitan France, 17 to 23 business days in Belgium, and 16 to 24 business days in Switzerland, including preparation. The products are shipped from the warehouses of partner suppliers located outside the European Union. Detailed terms are set out in the shipping policy, which forms an integral part of these terms and conditions.

Article 7 — Returns and right of withdrawal

The Seller applies a commercial return policy of 30 days from receipt. Independently of this, the Customer has the legal right of withdrawal of 14 days provided for in articles L221-18 et seq. of the Consumer Code. Detailed terms are set out in the return and refund policy, which forms an integral part of these terms and conditions.

Article 8 — Legal guarantees

All products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code) for 2 years from delivery, and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). These guarantees apply independently of any commercial guarantee.

Article 9 — Installation and safety

Lighting fixtures must be installed in compliance with current electrical standards. Any fixed connection to the network must be carried out by a qualified electrician, with the power cut off at the panel. The Seller cannot be held responsible for damage resulting from non-compliant installation or improper use of the product.

Article 10 — Liability

The Seller cannot be held liable in the event of non-performance attributable to the Customer, the unforeseeable and insurmountable act of a third party, or an event of force majeure.

Article 11 — Personal data

The processing of the Customer's data is described in the privacy policy.

Article 12 — Customer service and disputes

Customer service can be reached at contact@luniescence.store and at 06 02 01 54 73. These terms and conditions are subject to French law. In the event of a dispute, the Customer shall first contact the Seller for an amicable solution. Failing this, they may free of charge resort to consumer mediation. If you reside in another European Union country, you can contact the European Consumer Centre of your country: https://www.europe-consommateurs.eu. Failing agreement, the French courts shall have jurisdiction.
